Can British residents and expats buy Hong Kong insurance?

Possibly, subject to insurer acceptance and the rules where you live. UK residence matters more than a British passport for tax, and offshore policy gains can be taxable. Hong Kong Insurance Connect provides general information and refers enquiries to a licensed Hong Kong broker; we do not advise on or arrange policies.

Does “British expat” mean I am non-UK resident?

No. Use HMRC’s Statutory Residence Test, including days, work and ties. UK residents normally face tax on worldwide income; non-residents normally do not pay UK tax on foreign income. Citizenship and a foreign address alone do not settle residence. Split-year treatment and temporary non-residence need separate review. [B1, B2]

Can a Hong Kong insurer promote a policy to me in the UK?

FCA guidance says the section 21 restriction can reach overseas communications capable of having an effect in the UK. A business invitation or inducement generally needs an authorised communicator, lawful approval or an applicable exemption. Hong Kong licensing is not UK permission. General information is different from a sales promotion, but the substance of a communication matters. Have the broker confirm the permitted route before sales discussions; a Hong Kong signature does not retrospectively validate UK solicitation. [F1]

When can an offshore policy produce a UK tax charge?

Chargeable event gains are income, not ordinary capital gains. Maturity, full surrender, some assignments and partial withdrawals can produce gains; the chargeable amount need not equal the cash you withdraw. Foreign policies generally do not carry the deemed basic-rate tax credit available on many UK policies. Request transaction records and UK calculations rather than assuming a Hong Kong payout is tax-free. [B3, B4, B5]

What should I check before moving back to the UK?

Before returning, give a UK tax adviser the contract, start date, ownership changes, premium and withdrawal history, and residence timeline. Time-apportioned reduction may account for non-resident periods; it is not automatic exemption of the whole gain. Temporary non-residence can bring certain gains into charge on return. Ask about personal portfolio bond rules and available reliefs before changing investments or surrendering. Do not assume that buying before returning permanently shelters the policy. [B2, B3, B6]

Separately, ask the insurer in writing about continued cover, service restrictions, address changes and payment routes at your UK address. Tax residence and contractual continuation are separate questions; this guide does not verify an individual insurer’s continuation terms.

Which questions should I put to the broker and tax adviser?

Ask the broker whether the insurer accepts your current residence, where each sales step may occur and what UK permissions or exemptions are relied on. Ask your tax adviser how the exact contract is classified, which events create income, whether relief applies, and what records will be needed on return. Neither professional’s answer substitutes for the other’s review.

Read the UK country guide and US guide if you also have US status. Use the trust page to verify the broker and fulfillment ratios hub to understand historical non-guaranteed benefits. Those ratios are not a forecast or tax ruling. Send a general enquiry with your residence and intended move; the licensed broker handles advice and arrangement.

What do British buyers commonly ask?

Can I buy just because I hold a British passport?

No acceptance guarantee follows from nationality. Ask the broker about your residence and the exact insurer.

I work overseas. Do I still need to check UK tax residence?

Yes. Apply the Statutory Residence Test rather than relying on the word “expat”. [B1, B2]

Can the Hong Kong broker sell to me over a UK video call?

Do not assume so. Ask which UK permissions or exemptions apply to the proposed communications and activities. [F1]

Are Hong Kong policy gains capital gains in the UK?

Chargeable event gains fall within income-tax rules. Ask for a policy-specific calculation. [B3]

Does a tax-free Hong Kong payout mean no UK tax?

No. Foreign-policy treatment and UK residence determine the UK analysis; Hong Kong treatment does not settle it. [B4]

Does buying while abroad protect the policy when I return?

No automatic protection applies. Review non-resident periods, return rules and policy classification before moving. [B2, B6]

Should I surrender before my flight home?

Get individual advice first. The transaction and residence timeline matter; temporary non-residence rules may still apply. We cannot recommend a surrender date. [B2, B5]
